Sports Release of Liability, Waiver & Assumption of Risk

1. Participation

In consideration of the participant named below (the "Participant") being permitted to participate in softball practices, tryouts, training, games, tournaments, travel, team activities, and related events organized, sponsored, or supervised by 304 Havoc Softball (collectively, the "Activities"), I, the parent or legal guardian signing below, agree to the terms of this document on my own behalf and on behalf of the minor Participant.

2. Acknowledgment and Assumption of Risk

I understand that softball and related athletic activities are inherently dangerous and involve risk of serious injury, permanent disability, paralysis, and death, as well as loss of or damage to property. These risks include, but are not limited to: being struck by a ball, bat, or equipment; contact or collision with other participants or fixed objects; slips, trips, and falls; overuse and sudden-movement injuries; the condition of fields, facilities, and equipment; weather and environmental conditions; transportation to and from events; and the negligence of other participants or persons.

I knowingly and freely assume all such risks, both known and unknown, and assume full responsibility for the Participant's participation in the Activities. I certify that the Participant is physically fit and has no medical condition that would prevent safe participation, and I acknowledge it is my responsibility to consult a physician if in doubt.

3. Release and Waiver of Liability

To the fullest extent permitted by law, I, for myself, the Participant, and our heirs, executors, administrators, and assigns, hereby RELEASE, WAIVE, DISCHARGE, and COVENANT NOT TO SUE 304 Havoc Softball, and its board members, directors, officers, coaches, managers, volunteers, employees, agents, sponsors, and affiliated organizations (collectively, the "Released Parties") from and against any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, injury, or death that may be sustained by the Participant, or to any property belonging to us, while participating in the Activities, whether caused by the negligence of the Released Parties or otherwise, to the maximum extent allowed by law.

4. Indemnification and Hold Harmless

I agree to INDEMNIFY, DEFEND, and HOLD HARMLESS the Released Parties from any and all claims, actions, suits, costs, expenses, damages, and liability, including reasonable attorneys' fees, brought as a result of the Participant's involvement in the Activities or arising out of my or the Participant's conduct.

5. Medical Treatment Authorization

In the event of an injury or illness, I authorize the Released Parties to obtain or administer first aid and to arrange for emergency medical treatment, including transport to a medical facility, as they deem reasonably necessary for the Participant's safety and welfare. I understand that reasonable effort will be made to contact me first, and I agree to be financially responsible for the cost of any medical treatment or transport. This authorization does not obligate the Released Parties to provide such care.

6. Photo and Media Release

I grant 304 Havoc Softball permission to photograph and record the Participant during the Activities and to use such images, video, audio, and the Participant's first name and jersey number in team rosters, promotional materials, websites, and social media, without compensation. I understand I may withdraw this specific media consent at any time by contacting [email protected]; withdrawing media consent does not affect the rest of this release.

7. Governing Law and Severability

This document shall be governed by and construed in accordance with the laws of the State of West Virginia, without regard to its conflict-of-law provisions. If any portion of this document is held to be invalid or unenforceable, the remaining portions shall continue in full force and effect. I intend this release to be as broad and inclusive as is permitted by the laws of the State of West Virginia.

8. Electronic Signature Consent

I agree that signing this document electronically — by drawing my signature and typing my legal name below — has the same legal force and effect as a handwritten signature under the federal E-SIGN Act and the Uniform Electronic Transactions Act. I consent to conduct this transaction electronically and understand that 304 Havoc Softball will retain a PDF record of this signed release, including the date, time, and technical information about my submission.

Acknowledgment

I HAVE READ THIS RELEASE OF LIABILITY, WAIVER, AND ASSUMPTION OF RISK, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS — INCLUDING THE PARTICIPANT'S AND MY OWN RIGHT TO SUE — AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
